SightSweepTester portal

Draft for attorney review

Safety and Risk Acknowledgment

1. Nature of the experiment

I understand that SightSweep is an unfinished software prototype that uses camera input and experimental logic to provide awareness cues. It has not been established as a reliable means of avoiding collisions, restoring vision, authorizing driving, or replacing established assistive practices. I am volunteering feedback and can stop at any time.

2. Specific risks

I understand that important events may be missed or detected too late; an object may be mislabeled; a false cue may startle or distract me; a cue may point in an unhelpful direction; the stream, display, audio, or connection may stop; and software, hardware, battery, network, configuration, or environmental conditions may cause unexpected behavior.

Relying on an absent, incorrect, or delayed cue may contribute to a collision, fall, injury, death, property loss, or a dangerous response. Recording may capture identifying information or other people's conversations. A video that appears successful does not establish that the system will work reliably in another event.

3. My testing responsibilities

I will retain ordinary scanning, attention, mirrors, hearing, and any established mobility or vision aids. I will not treat SightSweep as permission to drive or undertake an activity that I am not otherwise legally and safely able to perform. I will not intentionally create traffic conflicts or other hazards to test detection.

I will configure and review the app only when safely stopped or out of a task requiring attention. I will use a passenger operator, a parked vehicle, or an appropriate controlled setting when practical. I will comply with applicable recording, licensing, traffic, and device-use rules and will stop if the app distracts me, interferes with an established aid, causes discomfort, or behaves unpredictably.

4. Voluntary participation and information

I have a reasonable opportunity to read the documents, ask questions, and decide whether to participate. I am at least 18. I understand that a display name and a checked box are not medical screening or an assessment of my fitness for driving or any other activity. No compensation, medical benefit, safety benefit, or successful result has been promised by this acknowledgment.

5. Assumption of disclosed risks

To the extent applicable law permits, I voluntarily accept the inherent, reasonably disclosed risks of using an experimental cueing prototype under lawful and otherwise safe test conditions. I do not agree to accept concealed risks, intentional wrongdoing, gross negligence, reckless conduct, or risks that a reasonable safety process should address and cannot lawfully disclaim.

6. Proposed limited release for counsel review

TO THE EXTENT AND ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW, I PROPOSE TO RELEASE JOE ELIO, AS THE SIGHTSWEEP OPERATOR, FROM MY CLAIMS BASED ON ORDINARY NEGLIGENCE ARISING DIRECTLY FROM THE SPECIFIC EXPERIMENTAL ALERT RISKS DESCRIBED ABOVE DURING MY VOLUNTARY AUTHORIZED BETA USE. THIS PROPOSAL DOES NOT RELEASE FRAUD, GROSS NEGLIGENCE, RECKLESSNESS, INTENTIONAL MISCONDUCT, UNLAWFUL DATA USE, OR LIABILITY THAT CANNOT LEGALLY BE WAIVED.

This language does not release the claims of a passenger, pedestrian, bystander, employer, insurer, or any other person who did not independently agree. It does not alter duties imposed by law, establish that an unsafe testing plan is acceptable, or authorize driving or recording violations. The scope, conspicuousness, assent process, insurance, and applicable state's treatment of negligence releases require attorney review before reliance.

7. No automatic bar to recovery

I understand that the enforceability of risk and release provisions depends on the facts and law. Arizona's constitutional and statutory treatment of assumption of risk may affect who decides the defense and how it applies. This acknowledgment is not a promise that any claim will be barred or that a release can substitute for careful development, safe testing, or appropriate insurance.

8. Reporting and stopping

I will stop using a build that appears unsafe and describe the issue through ordinary feedback when safe to do so. The submission portal is not continuously monitored for emergencies. I will seek appropriate emergency or professional help when needed. Choosing to stop will not prevent me from deleting my clips or exercising applicable privacy rights.

9. Record of acknowledgment

The portal records my account identifier, the version of this acknowledgment, the affirmative safety choice, and the time of acceptance. I can obtain those records through the account export while the account exists. My acknowledgment does not constitute a clinician's advice, a driving certification, or confirmation that a particular test activity is safe.
