SightSweepTester portal

Draft for attorney review

Beta Tester Agreement

1. Parties and acceptance

This agreement is between you, the adult individual using the tester account, and Joe Elio operating the SightSweep project. It covers the website tester portal, voluntarily submitted material, and experimental SightSweep builds provided to you. If an incorporated operator takes over the service, its exact legal name and notice information must be substituted before commercial release.

By affirmatively checking the agreement, privacy-notice, safety, and adult-confirmation boxes and selecting Create tester account or Accept updated agreements, you acknowledge the identified document version. The server records your site-specific identity, choices, and time. You can access these documents without signing in and keep a copy. Privacy notice acknowledgment is not a blanket consent to every possible use of personal data.

2. Eligibility and account responsibilities

You must be at least 18 and able to enter into this agreement. Use an account you control and provide accurate information. Do not impersonate another person, share app access credentials, or allow another person to submit footage as you. Protect the account used for sign-in and revoke a linked device if lost or compromised. Notify SightSweep through the Privacy request form if you suspect unauthorized access.

A tester account is separate from the early-access waitlist and from your ChatGPT account. Sign-in through ChatGPT identifies you; it is not an endorsement by OpenAI. A public website does not make private submission records public. SightSweep may limit tester access, upload volume, formats, and supported app versions to operate the beta.

3. Experimental nature and scope

SightSweep is an experimental awareness aid. It may attempt to identify activity within a selected awareness region and display or play a cue. Features may change or be unavailable. It is not a collision avoidance system, emergency warning system, certified driving aid, substitute for vision, or a device proven to prevent injury. No claim is made here that it diagnoses, treats, cures, or compensates for a medical condition to a clinically established standard.

Performance varies with camera angle, light, weather, motion, obstruction, frame rate, software settings, battery, wireless connection, device interruptions, and objects or situations outside the tested examples. The app can miss important events, misclassify objects, alert late, create false alarms, stop without warning, or distract or startle you. An alert does not establish a hazard and silence does not establish safety.

4. Safe and lawful testing

Keep ordinary attention, scanning, mirrors, hearing, mobility skills, and established assistive tools. Do not rely on SightSweep to decide when to turn, merge, cross a road, avoid an obstacle, drive, or enter another potentially dangerous situation. Never deliberately enter a hazard to produce a test clip. Stop testing if cues, glasses, or the app interfere with safe activity, cause discomfort, or divert attention.

Set up the app, change settings, label clips, and upload footage only while safely stopped or otherwise out of a safety-critical task. Vehicle testing must comply with traffic, licensing, recording, distracted-driving, and device-use laws. Prefer a passenger operating the app, a parked vehicle, or a controlled lawful setting. SightSweep does not authorize driving that a clinician, licensing authority, or applicable law would restrict.

Do not obscure your view, modify required safety equipment, or use the service where its failure could reasonably lead you to rely on it for emergency intervention. Call appropriate emergency services when needed. Reports submitted to the portal are development feedback and are not continuously monitored emergency requests.

5. Hardware and third-party services

You remain responsible for compatible hardware, connectivity, charging, and the terms of services you use. Meta glasses, Apple's operating system, ChatGPT sign-in, and the hosting platform are independent products. SightSweep is not endorsed by those providers. Their changes, account restrictions, SDK conditions, and device failures may affect availability.

Nothing in these terms grants rights under a Meta SDK agreement, app-store agreement, third-party recording license, or another person's privacy or publicity rights. A tester permission is insufficient if an upstream license prohibits a proposed use. Platform and SDK rights must be checked before model training, redistribution, or a broader release.

6. App license and restrictions

Subject to these terms and any distribution terms accompanying a build, SightSweep permits you to use the provided experimental app personally for authorized beta testing. This permission is limited, non-exclusive, revocable for material breach or termination of the beta, and does not transfer ownership of the app or detector.

Do not compromise accounts, bypass access controls, distribute private credentials, interfere with the service, introduce malicious content, conduct automated abuse, or use footage obtained unlawfully. Restrictions do not prohibit activity that applicable law expressly protects, authorized security research, accessibility use, or good-faith reports to authorities. No non-disparagement obligation is imposed.

7. Feedback and ownership

You retain ownership of your videos, comments, and other material to the extent you own them. To the extent your feedback contains your own non-personal ideas about features or defects, you grant SightSweep a non-exclusive, worldwide, royalty-free permission to use those ideas to improve and commercialize its products. This permission does not transfer video ownership and does not authorize marketing use of your likeness or broader processing of personal information.

Footage rights are governed by the Submission and Development Permission and your recorded per-clip choices. Future model training and public marketing use have separate permissions. Do not include another organization's confidential material, trade secrets, private conversations, or content you are not entitled to share. Your reports are suggestions; SightSweep is not required to implement them or compensate you unless separately agreed in writing.

8. Privacy and submission controls

The Privacy Policy describes collection, access, retention, deletion, and provider involvement. Uploaded clips are accessible to you and the authorized SightSweep developer for the stated purposes. The portal is not a social network or public gallery. Internal reviewer notes are retained for developer use and are not necessarily part of the tester-facing review status.

You may delete clips, change optional clip permissions, export your account record, revoke devices, and delete your account. Do not interpret review approval as confirmation that the footage is safe, legally recordable, or suitable for public release. A clip selected for a regression test does not establish general performance.

9. No warranty

TO THE EXTENT PERMITTED BY LAW, THE EXPERIMENTAL APP AND PORTAL ARE PROVIDED AS AVAILABLE AND AS IS, WITHOUT A PROMISE OF ACCURACY, RELIABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED AVAILABILITY, OR ERROR-FREE OPERATION. SIGHTSWEEP DOES NOT WARRANT THAT ANY ALERT WILL OCCUR, OCCUR IN TIME, OR CORRESPOND TO A REAL HAZARD.

These limitations do not exclude warranties or statutory protections that cannot lawfully be excluded. Any specific written promise made to you, mandatory consumer protection, or non-waivable legal duty remains subject to applicable law. Safety statements and reasonable care obligations cannot be replaced by a broad disclaimer.

10. Proposed limitation of liability

SUBJECT TO APPLICABLE LAW AND THE EXCLUSIONS BELOW, THE PROPOSED CONTRACTUAL LIMIT FOR CLAIMS ARISING FROM THE BETA SERVICES IS THE GREATER OF USD 100 OR THE FEES YOU PAID SIGHTSWEEP FOR THOSE SERVICES IN THE 12 MONTHS BEFORE THE EVENT. SUBJECT TO THE SAME QUALIFICATIONS, THE PROPOSAL EXCLUDES INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, AND CONSEQUENTIAL ECONOMIC LOSS TO THE EXTENT SUCH LOSS MAY LAWFULLY BE EXCLUDED.

This clause does not limit liability for fraud, intentional misconduct, gross negligence or recklessness, violations of non-waivable privacy or consumer rights, or personal injury or death where applicable law prohibits that limitation. It does not release claims belonging to people who did not agree. Counsel must determine whether the proposed cap is appropriate, enforceable, insured, and compatible with a driving-related beta. The separate risk acknowledgment is not an assurance that a waiver will defeat a claim.

11. Third-party claims and responsibility

You are responsible for your own unlawful recording, intentional misuse, and material misrepresentation of rights. If such conduct results in a third-party claim against SightSweep, any obligation to reimburse or indemnify must be limited to harm caused by that conduct and permitted by law. You are not responsible under this provision for SightSweep's own negligence, privacy breach, infringement, or misconduct.

SightSweep must notify you promptly of a claim for which it seeks reimbursement, allow a reasonable opportunity to respond, and obtain your written approval before imposing a settlement obligation on you. No obligation here requires you to waive a defense, accept unreasonable costs, or cover another party's non-waivable liability. Counsel should decide whether to retain this provision for individual consumers.

12. Availability and termination

SightSweep may pause the beta, restrict abusive accounts, remove unsafe or unlawful content, or discontinue a build. Where reasonably practicable, we will provide notice and an opportunity to export or delete account data. Urgent security, legal, or safety concerns may require immediate restrictions. A service suspension does not enlarge the rights granted in your footage or erase your applicable privacy rights.

You may stop testing at any time. Deleting the account ends linked portal access. Provisions that by their nature concern pre-termination conduct, ownership of the app, lawful dispute resolution, and limitations applicable to existing claims may survive, subject to your privacy choices and applicable law. No automatic right to continue using deleted footage is created by survival language.

13. Changes and electronic records

Material changes to tester terms require affirmative acceptance of a new version before new submissions. New optional processing purposes require a separate choice and are not retroactively added to existing clips. SightSweep may communicate operational notices through the website or contact details associated with your account; promotional marketing is separate.

You agree to receive these beta agreements and acceptance records electronically. Save or export a copy before deleting your account because the present deletion flow also deletes the portal's consent records. Electronic acceptance is evidence of your choices, not a guarantee of enforceability under every law or for every claim.

14. Governing law and disputes

For this Arizona-based project, Arizona law is proposed to govern contractual issues, excluding conflict-of-laws rules, but only to the extent this does not deprive you of mandatory protections where you reside. Any proposed Arizona forum must remain subject to applicable jurisdiction and consumer protections. The operator's place of business and final venue must be confirmed by counsel.

This draft does not impose binding arbitration, a class-action waiver, a jury-trial waiver, or a shortened limitations period. Before bringing an ordinary contractual dispute, either party may use the Privacy request form to seek a good-faith resolution; that process does not prevent urgent relief, statutory complaints, or timely filing of a claim.

15. General provisions

If a provision is unenforceable, it is limited or severed only as permitted by law; the remainder applies if it can reasonably stand. A failure to enforce a provision is not a continuing waiver. No partnership, employment, agency, or compensation relationship is created merely by testing. Assignment cannot expand consent or reduce mandatory rights; a successor must honor the applicable purposes and permissions.

The accepted beta terms, Privacy Policy, Safety and Risk Acknowledgment, and per-clip permission documents describe the beta arrangement, subject to any additional written build terms you accept. If they conflict, the narrower footage permission and mandatory law control the use of personal information. No document can override rights held by a bystander or an upstream platform.
